*Early Notice and Public Review of a Proposed
*Activity in a Floodplain

To:  All interested Agencies, Groups and Individuals
This is to give notice that Jefferson County, Alabama under 24 CFR Part 58 has conducted an evaluation as required by Executive Order 11988, to determine the potential affect that its activity in the floodplain will have on the human environment for the Community Development Block Grant program under a grant from the U.S. Department of Housing and Urban Development.

1.    The following is a description of all of the proposed activities that are located within the floodplain:
*a.     Existing activities that are occurring before proposed project is constructed: Use of gymnasium, weight room and outdoor *water splash park.
*b.    Proposed construction activities: Construction of new toilet rooms in the existing rear parking area, new HVAC unit for the existing gymnasium, and new finishes for the existing weight room.
*c.    New activities when proposed project is completed: No new activities will occur.  This project enhances the existing gymnasium *and weight room, and the proposed bathrooms are for use by people using the existing splash park.  The proposed Midfield *Community Center project is located at 410 Grant Street in Midfield, Jefferson County, Alabama 35228.
2.    The total number of acres of the floodplain: The total acreage of the community center and ball field property is approximately 19.25 acres, of which approximately 18 acres are within the floodplain.
3.    The total number of acres of the activity within the floodplain: The proposed construction activity within the floodplain consists of new flooring for the weight room (1,044 square feet) and new toilet rooms at the rear of the building (390 square feet).  This activity will encompass approximately 1,434 total square feet, which is .033 acres.
4.    The related natural and beneficial functions and values of the floodplain that may be adversely affected by the proposed activity:  This project does not bring any new activities to the floodplain; therefore, there are no adverse effects to the floodplain caused by this proposed project.  In addition, this project is not creating any additional storm water run-off or impervious surfaces, so the floodplain will not be affected by the proposed construction.

There are three primary purposes for this notice.  First, people who may be affected by activities in floodplains and those who have an interest in the protection of the natural environment should be given an opportunity to express their concerns and provide information about these areas.  Second, an adequate public notice program can be an important public educational tool. The dissemination of information about floodplains can facilitate and enhance Federal efforts to reduce the risks associated with the occupancy and modification of these special areas. Third, as a matter of fairness, when the Federal government determines it will participate in actions taking place in floodplains, it must inform those who may be put at greater or continued risk.

Separate sealed bids from qualified General Contractors for the new Cordova City Hall and Police, for the City of Cordova will be received at the Cordova City Hall, 3885 North Massachusetts Avenue, Cordova, Alabama 35550, until 2:00 PM, May 06, 2014.
No Bids will be accepted after 2:00 PM, May 06, 2014. This requirement will not be waived. The official time will be determined by the Architect, or his designated representative. The proposals will be publicly opened May 06, 2014 at 2:00 PM at the location listed above.

The Jefferson County Commission will receive bids for the **GRAYSVILLE EAST BALL PARK IMPROVEMENTS PROJECT  at Room 270 of the Jefferson County Courthouse until 10:00 a.m. local time on the * 1st day of  *May 2014 , at which time and place all bids will be publicly opened and read aloud.

All bidders be advised that this contract is subject to Section 3 of the Housing and Urban Development act of 1968, as amended, (12 USC l701U) which if it is in excess of $100,000, requires that to the “greatest extent feasible”, opportunities for training and employment be given lower income residents of the project area and contracts for work in connection with the project be awarded to business concerns which are: (1) 51 percent or more owned by section 3 residents; or (2) Whose permanent, full-time employees include persons, at least 30 percent of whom are currently section 3 residents, or within three years of the date of first employment with the business concern were section 3 residents; or (3) That provides evidence of commitment to subcontract in excess of 25 percent of the dollar award of all subcontracts to be awarded to business concerns that meet the qualifications set forth in paragraphs (1) or (2) in this definition of “section 3 business concern.”

The City has determined that the project will have no significant impact on the human environment. Therefore, an Environmental Impact Statement under the National Environmental Policy Act of 1969 (NEPA) is not required. Additional project information is contained in the Environmental Review Record (ERR) on file at the City’s Community Development Department, 10th Floor-City Hall, 710 North 20th Street, Birmingham, Alabama 35203-2289 where the record is available for review and may be examined or copied for cost of reproduction weekdays 8:00 A.M. to 5:00 P.M.
*PUBLIC COMMENTS
Any individual, group, or agency disagreeing with this determination or wishing to comment on the project may submit written comments on or before May 5, 2014 to John Colòn, Director, Community Development Department, 10th Floor, City Hall, 710 20th Street, Birmingham, Alabama 35203-2289.  All comments received by May 5, 2014 will be considered by Mr. Colòn, prior to issuing a “Notice to Proceed.”
*RELEASE of FUNDS
The City certifies to HUD that the City and William A. Bell, Sr., as Mayor and certifying officer consents to accept the jurisdiction of the Federal Courts if an action is brought to enforce responsibilities in relation to the environmental review process and that these responsibilities have been satisfied. HUD’s approval of the certification satisfies its responsibilities under NEPA and related laws and authorities, and allows the City of Birmingham, AL to use Program funds.
*OBJECTIONS to RELEASE of FUNDS
HUD will accept objections to its release of funds and the City’s certification for a period of fifteen days following the anticipated submission date or its actual receipt of the request (whichever is later) only if they are on one of the following bases: (a) the certification was not executed by the Certifying Officer of the City of Birmingham; (b) the City has omitted a step or failed to make a decision or finding required by HUD regulations at 24 CFR Part 58; (c) the grant recipient has committed funds or incurred costs not authorized by 24 CFR Part 58 before approval of a release of funds by HUD; or (d) another Federal agency acting pursuant to 40 CFR Part 1504 has submitted a written finding that the project is unsatisfactory from the standpoint of environmental quality. Objections must be prepared and submitted in accordance with the required procedures (24 CFR Part 58) and shall be addressed to Office of Community Planning and Development at HUD’s Birmingham Office, Medical Forum Building, Suite 900, 950 22ND Street, North, Birmingham, AL 35203-5301. Potential objectors should contact HUD to verify the actual last day of the objection period.
